Please read these Terms of Service ("Terms") carefully before using Clinical Research Question Bank ("Service," "Platform," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing our website, or using any of our services, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Clinical Research Question Bank provides an online exam preparation platform featuring practice questions, study materials, and performance tracking tools designed to help users prepare for clinical research certification exams (ACRP, SOCRA, and related certifications). The Service includes access to a question bank, explanations, study guides, and progress analytics.

3. User Accounts

3.1 Account Registration

To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Not share your account with others

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. You may terminate your account at any time by contacting us.

4. Payments and Refunds

4.1 Fees

Access to certain features of the Service requires payment. All fees are stated in U.S. dollars and are non-refundable except as expressly stated in our refund policy. Prices are subject to change without notice.

4.2 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service. We do not store your payment card information.

4.3 Refund Policy

We offer a Pass Guarantee: complete the program and pass your certification exam within 6 months, or receive a full refund. To qualify for a refund: (1) complete at least 80% of the question bank, (2) take your ACRP or SOCRA certification exam within 6 months of purchase, (3) provide official exam results showing you did not pass, and (4) email your results to support@clinicalresearchquestionbank.com. Refunds are limited to one per customer. Access to the Service will be revoked upon refund issuance. Additionally, we offer a standard 7-day satisfaction guarantee from the date of purchase for any reason.

4.4 Subscription Auto-Renewal

If you purchase a subscription, it will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.

5. Acceptable Use Policy

You agree not to:

• Copy, reproduce, distribute, or share content from the question bank without authorization
• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use automated tools (bots, scrapers) to access or extract data from the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity or misrepresent your affiliation
• Share your account credentials with others

6. Intellectual Property Rights

All content, materials, questions, explanations, graphics, logos, and software associated with the Service are the property of Clinical Research Question Bank or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

7. User-Generated Content

If you submit feedback, suggestions, or other content to us, you grant us a worldwide, royalty-free, perpetual license to use, modify, and incorporate that content into our Service without attribution or compensation.

8. Disclaimers and Limitations of Liability

8.1 Educational Purposes Only

The Service is provided for educational and exam preparation purposes only. We do not guarantee that using the Service will result in passing any certification exam. Exam content, requirements, and standards are determined by third-party certification bodies (ACRP, SOCRA, etc.) with which we are not affiliated.

8.2 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLINICAL RESEARCH QUESTION BANK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clinical Research Question Bank regarding the use of the Service and supersede all prior agreements and understandings.
